Required Training – Corrective Action

North Carolina received a complaint filed against the state on behalf of all students attending public schools. The complaint alleges that “because of NCDPI’s failure to effectively exercise its general supervisory responsibility to identify and correct non-compliance related to MTSS/RTI and Child Find requirements, NCDPI is unable to ensure that a Free and Appropriate Education has been made available to all eligible children in North Carolina in accordance with 34 CFR 300.101”.

This means that some believe that MTSS/RTI is being implemented in a way that prevents parents, teachers, or other school personnel from making a referral to special education. MTSS remains a way to help improve student achievement, it is not a pathway to special education and cannot interfere with a school’s Child Find responsibilities or a parent’s right to request an evaluation for special education.

NCDPI has found weaknesses in the general supervisory roles and policy. The policy changes are being taken to the State Board and will likely not affect your day-to-day work. However, the general supervisory deficits require some action by the state. This action (passed on to the LEAs) requires that all instructional personnel are required to participate in a short training. Instructional personnel includes licensed staff, counselors, administrators, Title I teachers and assistants, teacher assistants, or any other staff involved in instruction or monitoring student academic, behavioral, or functional needs.

This training is required and must be completed no later than February 26, 2021.
